Several Asian American civil rights groups have submitted an amicus brief to the United States Supreme Court to support Native American tribes in North Dakota who sued the state over its unfair redistricting process.
According to a press release from the Asian American Legal Defense and Education Fund, the tribes say North Dakota’s redistricting efforts in 2021 illegally dilutes the voting strength of Native Americans.
The case, Turtle Mountain Band of Chippewa Indians v. Howe, was reviewed by the Eighth Circuit Court, which ruled that the plaintiffs did not have the right to challenge the redistricting plan. The plaintiffs are asking the Supreme Court to review the case.
In their brief, Asian American civil rights groups argued that the Eighth Circuit’s ruling paves the way for allowing only the Department of Justice to bring cases to enforce the Voting Rights Act (VRA). This means that certain protections under the VRA, like language access, might fall by the wayside.
